The Spanish cannabis market in data

Spain has three cannabis markets under three legal regimes: a medical market that opened in October 2025 and runs only through hospital pharmacies, a CBD and hemp sector whose legal status is unresolved, and adult use through clubs, home cultivation and the illicit market. This page brings together the latest data on all three.

Medical cannabis is legal, but only through hospital pharmacies

Real Decreto 903/2025 allows standardised oral preparations, prescribed by specialists for four indications. A year on, the bottleneck is the register: few products have been approved and hospitals are still writing their protocols.

Spain imports, treats and re-exports medical cannabis

AEMPS authorised 30.6 t of exports and 26.9 t of imports in 2025, against 20.3 t of authorised production. Much of the trade is product that crosses the border to be irradiated or processed and then returns. Portugal supplied 44% of imports in the first half of 2026.

• Questions

What people ask us about Spain

Can a patient in Spain get medical cannabis today?
Only through a hospital pharmacy, on a specialist's prescription, as a standardised oral preparation. Flower is not included. By September 2026 AEMPS had registered two preparations, both Curaleaf's, out of 13 applications from five laboratories. Sativex and Epidiolex, two medicines approved before the decree, remain a separate route.
Why can't community pharmacies dispense?
Article 9.1 of Real Decreto 903/2025 limits dispensing to hospital pharmacy services. Six autonomous communities are piloting collaborative dispensing, where a community pharmacy hands over a hospital prescription. Pharmacists' bodies have appealed the restriction at the Supreme Court, and a review of the decree is expected by the end of 2026.
How much medical cannabis does Spain export?
AEMPS authorised 30.6 tonnes of exports and 26.9 tonnes of imports in 2025, against 20.3 tonnes of authorised production. Much of that trade is processing: product enters Spain to be irradiated, extracted or finished and leaves again. Of the destinations that publish country-of-origin data, the UK and Germany recorded 8,211 kg arriving from Spain in 2025.
Is CBD legal in Spain?
CBD products are sold openly in shops and online, but the legal status of CBD flower is unresolved. In 2026 the Supreme Court held that THC in CBD flower can fall under narcotics law, and hemp cultivation fell 91% between 2020 and 2024 as enforcement rose.
How often is this page updated?
Each series is refreshed when its source publishes: AEMPS trade and licensing data through our transparency requests, EDADES every two years, and company data each September.

What we leave out
Four Spanish series in our platform are not on this page because they did not pass our checks: a retail count that disagrees with its own summary, a market model with an unresolved currency basis, a growshop series flagged for verification and a synthetic-cannabinoid count that differs between summary and source.
Two export figures, on purpose
AEMPS counts every authorised shipment, including product that only passes through Spain for processing. The UK and German regulators count what arrives from Spain. We show both and never add them together.

Take it into your Spain plan, with 120+ other markets beside it. For Spain alone, the Spain dashboard has every company and retailer behind these figures.
